Iowa man requests release from life in prison because he 'briefly died'

Benjamin Schreiber

Because of this, he said he fulfilled his "life" sentence.

They said that he was "unlikely" to be dead, as he had signed his own legal documents in the case.

On Wednesday, the Iowa Court of Appeals published a document saying that they could not dispute the spiritual and medical definition of death. The cause of his illness turned out to be large kidney stones, which led to septic poisoning. Even though he had a do-not-resuscitate order on file at the hospital, medical staff resuscitated him five times and then operated to fix his organs damaged by the kidney stones.

Benjamin Schreiber argued that he has "briefly died" in 2015 when his heart stop beating.

When he lost consciousness at the University of Iowa Hospitals & Clinics, a staff member called his brother, who told the hospital that although it could give Mr Schreiber medicine to ease his pain, "otherwise you are to let him pass", according to Mr Schreiber's petition.

A prisoner has claimed that his life sentence is technically over because he died and was resuscitated behind bars.

The District Court ruled on Schreiber, a decision made by his lawyer to the State Court of Appeal.

The Iowa Courtroom of Appeals turn into unmoved, on the other hand, by Benjamin Schreiber's uncover for freedom ruling that the argument - on the other hand unique - turn into "unpersuasive". It notes that Schreiber cited no case law to bolster his arguments.

An attorney for Schreiber did not immediately respond to requests for comment Friday morning.

Schreiber also had said in his post-conviction relief application that his due process rights were violated because the hospital didn't abide by his do-not-resuscitate order.
