Supreme Court clears the way for new asylum restrictions to take effect

The Trump administration unveiled the new asylum policy in July but it was nearly immediately blocked from taking effect by a lower court ruling by a judge in San Francisco. It would also put an end to the "caravans" of thousands who trek north from Honduras, Guatemala and El Salvador to reach the United States, since they must cross through Mexico and - according to the new rule - apply for asylum there in order to be welcomed at the USA border. Specifically, the Departments of Justice and Homeland Security are revising 8 C.F.R. § 208.13 (c) and 8 C.F.R. § 1208.13 (c) to add a new bar to eligibility for asylum for an alien who enters or attempts to enter the United States across the southern border, but who did not apply for protection from persecution or torture where it was available in at least one third country outside the alien's country of citizenship, nationality, or last lawful habitual residence through which he or she transited en route to the United States.

The shift reverses decades of United States policy.

The Trump administration says the policy is created to address deficiencies in an immigration system in which immigrants often pass initial asylum screening but fail to win final approval.

In December, a divided Supreme Court refused to let Trump start automatically rejecting all asylum claims by people who cross the southern border illegally.

But Ebrard said he told US officials that neither his government or the Mexican Senate would agree to such a deal, stressing that he believes the two sides have accomplished "90%" of the goals they outlined in June, when Mr. Trump was threatening to impose tariffs on Mexican goods unless Mexico did more to stem the flow of migrants.

Justices Ruth Bader Ginsburg and Sonia Sotomayor dissented, saying the court acted too quickly and should allow the case to work its way through the normal judicial process.

The administration's new policy says that those truly seeking asylum could ask for it in Mexico, which is deemed a safe country.

Eight days after the rule went into effect in July, California-based US District Judge Jon Tigar issued a nationwide injunction blocking it.

Tigar's decision prompted three judges on the 9th Circuit to tighten Tigar's order so only Arizona and California would be under its rubric.

That remaining the administration totally free to enforce the plan on asylum seekers arriving in New Mexico and Texas.

On Monday, Tigar issued a new order reimposing a nationwide hold on asylum policy. The 9th Circuit again narrowed his get on Tuesday.

The high court action allows the Republican administration to impose the new policy everywhere while the court case against it continues.

The rule change overturns long-standing convention that the USA hears asylum claims no matter how people have arrived at the border. But it would apply to the majority of asylum seekers from Africa, Asia and elsewhere in South America. They have repeatedly accused migrants of preferring to seek asylum in the US, rather than in the countries along their journey that might be able to offer them safe haven. They would be placed in fast-track deportation proceedings and flown to their home countries at US expense.
