White House Says It's Blocking Don McGahn From Testifying In Congress

The subpoena issued to Mazars has precipitated one of several legal clashes between House Democrats and the president's legal team and White House counsel - who have vowed to defy most of Democrats' subpoenas.

- A federal judge in Washington ruled Monday against President Donald Trump in a financial records dispute with Congress.

Last year, Cohen was sentenced to three years in prison for lying to Congress, as well as fraud, tax evasion and making unlawful campaign contributions, including "hush money" payments to women who sued Trump to be released from non-disclosure agreements they claimed they had been forced to sign. McGahn did not follow through with the demand, but Democrats say the documented interactions that suggest Trump was trying to interfere with the Russian Federation investigation could constitute obstruction of justice. If McGahn were to defy Trump and testify before Congress, it could endanger his own career in Republican politics and put his law firm, Jones Day, in the president's crosshairs.

Mr Trump later maintained he had authorised this co-operation with Mr Mueller.

In its legal opinion, the Justice Department believed Congress "could not lawfully exercise any inherent contempt authority against Mr. McGahn for asserting immunity".

Assistant Attorney General Steven Engel sent the current White House counsel, Pat Cipollone, a 15-page legal memo on Monday detailing what Engel called the reasons that the White House can keep McGahn and his documents out of the hands of lawmakers. McGahn is now barred from talking to Congress, the White House says.

Cipollone echoed the DOJ in his letter, writing that McGahn is "absolutely immune" from testimony and thus "the President has directed Mr. McGahn not to appear".

In April, the White House ordered former official Carl Kline to avoid testifying about the administration's security clearance processes without having counsel present.

"At the President's direction, the White House has been completely transparent with the Special Counsel's investigation".

The Justice Department has long held the opinion that close presidential advisers have "absolute immunity" from being compelled to testify before Congress about their work for the president.

"Mr McGahn is a critical witness to numerous alleged instances of obstruction of justice and other misconduct described in the Mueller report", Nadler said last month.

Nadler has threatened to hold McGahn in contempt if he refuses to testify.
