16-year-old illegal immigrant dies in Border Patrol custody

The boy was transferred to the Weslaco Border Patrol Station on Sunday from a processing center and was scheduled to be placed with an agency in the Health and Human Services for resettlement.

Bowen's defense lawyer, Sean Chapman, said that while some of his client's text messages could be "perceived as racist or offensive", they would not help a jury determine whether he "set out to use excessive force to apprehend the alleged victim" in the December 2017 attack.

McAleenan said Customs and Border Protection has about 16,000 illegal immigrants in custody, and is utilizing all resources and options to process them.

Bowen goes on trial August 13 on charges of depriving the Guatemalan migrant of his rights under the color of law and falsifying records after the December 3, 2017, incident in Nogales, Arizona.

Bowen is accused of making false statements both in his initial report and in a subsequent memo to the chief patrol agent of the Tucson Sector, saying "he never meant to strike, scare or otherwise come into contact" with the man. This marks the fifth time since December where a migrant child died while in USA custody.

In another text, someone asked Bowen "Did you gas hiscorpse [SIC] or just use regular peanut oil while tazing?? For a frying effect".

He replied: 'Guats are best made crispy with an olive oil from their native pais'.

The messages sent by Nogales Agent Matthew Bowen, 39, have been unearthed by federal prosecutors that suggest a disdain towards immigrants.

Juan de León Gutiérrez, 16, died of illness in April, and a 2-year-old died last week after being hospitalized for pneumonia.

After another rock throwing incident in November 2017, Bowen sent Swartz a message calling the throwers "mindless murdering savages".

He also used derogatory terms for immigrants in several other texts.

Criminal charges against Border Patrol agents over assaults on migrants are relatively unusual, with most cases focused on officers' involvement in crimes such as drug smuggling or lying on job applications. He pleaded not guilty to all charges.

Bowen was among three agents who approached the man, since identified as Guatemalan national Antolin Lopez Aguilar, 23, after spotting him hiding under a semi-trailer.

The man fell to the ground after Bowen hit him with the truck a second time. Prosecutors detailed a string of incidents over the years that had seen Bowen accused of undue violence against migrants.

The cause of death is unknown and the incident is being reviewed by CBP's Office of Professional Responsibility.

Advocates demanded that President Donald Trump's administration act to safeguard the lives of children in detention as border crossings surge and the U.S. Border Patrol detains thousands of families at a time in overcrowded facilities, tents, and outdoor spaces.
