Stalled Pennsylvania New York gas pipeline could get a boost from Trump’s executive order

One of the executive orders will direct the Environmental Protection Agency to revise the way states can consider the Clean Water Act when deciding whether to approve pipelines, according to a senior administration official.

"An executive order can not take off the table the ability of a state to say no for reasons it believes are appropriate, and the venue for adjudicating that is not the White House" - it's the courts, Tezak said.

Szybist also questioned to what extent pipeline permitting in Pennsylvania will be affected by the order, given that the state has not experienced some of the same high-profile fights over pipelines as its neighbors that have denied projects under the Clean Water Act.

"Reducing the amount of time states have to review projects or limiting the number of factors states may consider would infringe upon the legal authority clearly reserved to state governments under the Clean Water Act, " she said.

The second executive order Trump signed on Wednesday streamlines the process for energy infrastructure that crosses worldwide borders.

The Transportation Department would propose a rule that would allow liquefied natural gas to be shipped in approved rail tank cars. Trump specifically called out New York's blocking of the Constitution natural gas pipeline.

He also highlighted that under his new order, U.S. presidents would have sole authority to approve or disprove pipeline projects that cross borders.

Trump stopped in Crosby for the signing on his way to meet with supporters and fundraisers in Houston.
