"Empire" actor Jussie Smollett is charged disorderly conduct, accused of orchestrating a fake hate crime against himself because he was upset with his salary.

"Some of the cast wanted to send him a message, like a "We're thinking of you" thing, and asked people to sign it, but a lot of people were disgusted" said a source according to Page Six. At least one of the brothers had appeared as an extra on "Empire", and Schmidt said they hoped Smollett could help their careers, but they now feel he betrayed them.

Jussie Smollett's case reached a new level on Friday after a grand jury revealed that he's been indicted on 16 felony counts for filing a false police report - one count for each alleged false statement he provided to police during two interviews.

Prosecutors allege that Smollett, who is black and gay, enlisted the help of two other black men and staged the January 29 attack because he was unhappy with his salary and wanted to promote his career.

The siblings claimed Smollett had paid them to help him pull off the hoax after meeting through his work on hip-hop drama series "Empire", and they were subsequently released without charge. If you're friends and I'm saying, "Hey, I'm going to pay you for training but I'm also asking you to do me a favor" and the favor was to stage the attack, ' Schmidt said on Good Morning America. "They also did not know that their loyalty to him would be betrayed".

But according to a new TMZ report, the brothers insist the $3500 check was payment for training and diet regimen created to get Smollett in shape for a music video shoot.

Schmidt said the Osundairo brothers are not looking for anything from police or prosecutors in exchange for their grand jury testimony against Smollett.

Smollett's attorney, Mark Geragos, has questioned why the Osundairo brothers were not indicted alongside him. What they do have is a whale of a case. Police initially investigated the case as a possible hate crime.
