Lawyers said Thursday the executive had developed a fever, which has subsided since.

"I have been wrongly accused and unfairly detained based on meritless and unsubstantiated accusations", the once-revered vehicle titan told the court.

He had already been indicted on a separate charge of underreporting his pay.

Ghosn was charged with aggravated breach of trust for temporarily transferring personal investment losses to Nissan in 2008, and for understating his compensation for three years, from 2015 to 2017, showed a statement from his lawyer, Motonari Otsuru.

It also alleges that he used company funds to repay a Saudi acquaintance who put up collateral for the contracts. Prosecutors may come up with new allegations or charge him.

On Tuesday, Ghosn's lawyers said their client might remain behind bars until a trial begins, which may not happen for another six months.

Ghosn's wife, Carole, painted a glum picture of her husband's state, saying she's fearful for his health and that he's been denied access to his family since the November 19 arrest in Tokyo.

One of the most recognisable foreign executives in Japan, Ghosn was led into Tokyo District Court in handcuffs and with a rope around his waist and was noticeably thinner. "In all of my efforts on behalf of the company, I have acted honorably, legally and with the knowledge and approval of the appropriate executives inside the company".

The judge said his ongoing detention was justified because he poses a flight risk and could tamper with evidence if released.

A request filed the same day by his lawyers to end his detention was rejected.

Japan's prosecutors have faced criticism for a lack of clarity and communication on how they are handling the case, with Ghosn held in detention without charge for longer than would be permitted in the United Kingdom for a suspected terrorist.

Japanese prosecutors are likely to indict him Friday, when his current detention period expires for the alleged breach of trust. He said he expects Ghosn and Kelly to be tried together on the two charges and that he will work closely with Ghosn's legal team to prepare for the trial.

The jet-setting high-flyer who once sparked criticism for his lavish lifestyle has gone from spacious digs in worldwide capitals to a one-man cell.

He has reportedly complained about the rice-based diet at the detention centre, with his family saying he has lost up to 20 kilos (44 pounds).

"The second indictment for Kelly comes as no surprise as it merely makes what was a five-year period for the first into eight years", said Kelly's lawyer Yoichi Kitamura.

The 64-year-old has been formally charged with under-declaring his income by tens of millions of dollars in an apparent bid to quash accusations he was overpaid.

Nissan as well as Mitsubishi, the third alliance partner, have removed Ghosn as chairman, but Renault has kept him on while appointing a deputy CEO to ensure day-to-day management.

The company said in a statement that it took the latest charge seriously and was strengthening governance.
