Netflix sued over Bandersnatch's similarities to Choose Your Own Adventure

According to Variety, Chooseco LLC, the Vermont-based publisher of the book series, claims Netflix "exploited the brand awareness of the book series to launch the show".

It's worth noting that Bandersnatch is certainly not the first example featuring choose-your-own-adventure styled storytelling, with various video games having incorporated choice-based storylines as well (think Until Dawn).

Chooseco alleges they warned Netflix not to use the trademark in Bandersnatch before the film was released globally.

Referencing Netflix pursuing a licence in 2016, the complaint stated: "Chooseco and Netflix engaged in extensive negotiations that were ongoing for a number of years, but Netflix did not receive a licence". The movie was billed as a "choose your own adventure" tale, even though the company largely refrained from actually using that phrase in the marketing. According to THR, Chooseco accused Netflix of confusing people, with many reportedly linking the publishers to the dark flick.

Furthermore, the publisher claims that it has registered the phrase in connection with movies, books and other forms of media. "The misappropriation of the trademark without permission puts Chooseco in a hard situation as the graphic and offensive nature of the content is particularly damaging for fans of the series young and old, and tarnishes the mark". Chooseco is asking for $25 million in damages.

The suit also notes that 20th Century Fox recently optioned the rights to create a film based on the series, which is now in the works.

"Bandersnatch" lets viewers "choose their own adventure", but Netflix is being sued for use of that terminology.

The claim also specifically calls attention to a moment early in Bandersnatch when protagonist Stefan Butler (Fionn Whitehead) tells his father that the book he's reading is a "Choose Your Own Adventure book".

The misappropriation of our mark by Netflix presents an extreme challenge for a small independent publisher like Chooseco.
