Man on death row for 36 years set to be executed

A Tennessee inmate is scheduled to become the second person to die in the state's electric chair in as many months Thursday evening, almost two decades after Tennessee adopted lethal injection as its preferred method of execution.

States have moved away from the electric chair in recent decades - and no state uses electrocution as its main execution method anymore.

The Tennessee Department of Correction says David Earl Miller will be served the meal on Thursday afternoon.

Tennessee inmates have had no luck convincing courts to strike down the state's three-drug method of lethal injection, which they argue causes prolonged pain.

But the state recently resumed executions and has put two men to death this year.

Lethal injection is the preferred method of putting people to death in all US states that have the death penalty, according to the Death Penalty Information Center. Miller, who has been on death row for 36 years, was sentenced to death for the 1981 murder of 23-year-old Lee Standifer in Knoxville.

In November, Edmund Zagorski died by electric chair after a federal court judge ordered the state to honor the inmate's wishes.

Miller still has two last-minute petitions asking the justices to halt his execution.

First used in 1890, execution by electric chair was developed as a "humane alternative" to hanging.

The execution plan comes almost two decades after Tennessee adopted lethal injection.

Miller was convicted of the 1981 killing of a 23-year-old mentally handicapped woman, Lee Standifer, in Knoxville.

Gov. Bill Haslam earlier Thursday turned down a request to commute Miller's sentence to life in prison.

David Earl Miller filed one request on Monday, arguing the electric chair is unconstitutional but the state's lethal injection method is worse.

The builder of Tennessee's electric chair warned that it could malfunction, but Zagorski's execution seemed to be carried out without incident. He was the second inmate in more than a month to choose electrocution. Standifer was beaten to death with a fireplace poker and stabbed several times.

The electric chair is an option only for Tennessee death row inmates whose crimes occured before 1999.
