White House threatens to suspend CNN reporter's pass again when order expires

The legal fight between the White House and CNN was sparked earlier this month with a tussle between Trump and Acosta during a press briefing in the East Room.

Acosta had his White House press credentials revoked when he became the target of Donald Trump's ire after asking a series of questions at a press conference about the president's inflammatory comments concerning a migrant caravan traveling towards the USA border.

Upon arrival at the White House, Acosta sauntered up to a gaggle or reporters, smugly smiled, and then asked his friends, "Do you want to ask a question or.?"

According to CNN, the White House sent Acosta a letter on this weekend warning the correspondent that his press pass would be suspended again after the restraining order expires.

By the end of the day, Acosta press credentials had been revoked.

Ted Boutrous, an attorney for CNN and Acosta, told Stelter on "Reliable Sources" that in the absence of reaching an agreement with the White House, they plan to seek a preliminary injunction blocking the White House from suspending Acosta's credentials for a much longer period of time as the case moves forward.

"What they said, though, is that we have to create rules and regulations for conduct etc. etc". "It's not a big deal, and if he misbehaves we'll throw him out or we'll stop the news conference".

At the hearing over the CNN lawsuit, U.S. District Judge Timothy Kelly said there was no due process in taking away Acosta's hard pass and added that Sanders' initial remark about Acosta touching the White House intern who tried to take away his microphone was "likely untrue and at least partly based on evidence that was of questionable accuracy".

When the intern came to take the microphone from him, Mr. Acosta refused to give it back, using his hand to chop at the woman's elbow to prevent her from controlling the microphone. But he also found that a reporter's "First Amendment liberty interest in a White House press pass" is also protected by the Fifth Amendment's due process guarantees, as The Washington Post's Erik Wemple previously reported. "From the looks of the letter, the W.H.is trying to establish a paper trail that will empower the administration to boot Acosta again at the end of the month". Trump said. "I mean, with this stuff, you never know what's going to happen".
