Pharmacist Fired for Refusing to Fill Transgender Woman's Hormone Prescription

ACLU of Arizona

Hilde Hall penned a blog post on the American Civil Liberties Union's (ACLU) website on Thursday stating that he was "humiliated" when a pharmacist at a CVS Pharmacy in Fountain Hills, Arizona, refused to fill a hormone therapy prescription in April. When she called her doctor's office to explain, the prescription was sent to a nearby Walgreens, where it was filled "without question".

"I was finally going to start seeing my body reflect my gender identity and the woman I've always known myself to be", said Hall, who declined through an ACLU spokesperson to be interviewed for this article.

She said the pharmacist also refused to give back her prescription note, meaning she couldn't get it filled at another pharmacy.

"He did not give me a clear reason for the refusal", Hall said in the complaint.

Hall said she was "elated" when she left her doctor's office April 24 with three prescriptions.

"He did not give me a clear reason for the refusal", Hall wrote, "embarrassed and distressed, I almost started crying in the middle of the store", she continued.

Hall, who says she will never return to that CVS as she never wants to see 'the pharmacist who discriminated against me, ' says she complained to both CVS and the Arizona State Board of Pharmacy.

'CVS Health extends its honest apologies to Ms. Hall for her experience at our pharmacy in Fountain Hills, Arizona last spring, ' he added.

CVS posted its response on Twitter, apologizing to Hall and saying the pharmacist was no longer employed by the company. The chain said the pharmacist's action "does not reflect our values or our commitment to inclusion, nondiscrimination and the delivery of outstanding patient care".

A transgender woman claims a CVS pharmacist refused to fill her hormone therapy prescription. The woman's doctor had told her the pregnancy was unviable, and another Walgreens filled her prescription. When no one addressed her concerns, she chose to file a complaint with the Arizona State Board of Pharmacy on Thursday.

A CVS spokesman said it requires pharmacists to notify the company in advance about any religious convictions they have that would interfere with their ability to perform their job, so management "can ensure there are other arrangements in place to ensure the patient's medication needs are promptly satisfied".

"We also apologize for not appropriately following up on Ms. Hall's original complaint to CVS, which was due to an unintentional oversight, " the company added in its statement.

"She's obviously not the first person this has happened to, so the more people we can make aware of the problem, the better", he said.

"There isn't a similar statute in Arizona that allows pharmacists to refuse service related to other medications", Kilar said. She also filed a complaint with the Arizona Board of Pharmacy, which investigates concerns about pharmacists' conduct.

Skinner-Thompson said that holding companies like CVS accountable to anti-discrimination policies in high-profile instances helps further the LGBTQ rights movement.
