Campaigner pledges to fight on for abortion access in court

Ireland abortion laws

However, the court proceeded to rule that notwithstanding this decision, the current law in Northern Ireland is incompatible with Article 8 of the European Convention on Human Rights due to its blanket ban on abortions in circumstances of fatal foetal abnormality (5:2), rape (4:3) and incest (4:3).

But in an important caveat, Justice Brenda M Hale, president of the court, said that a majority of the justices "are of the firm and clear opinion that the current law is incompatible with" the European Convention on Human Rights, to which Britain is a party.

The law allows for abortions in Northern Ireland only if a woman's life is at risk or if there is a risk of permanent and serious damage to her mental or physical health.

The current abortion laws, the most restrictive in the United Kingdom, subject women to "inhumane and degrading treatment" and violate privacy rights in the European Union charter.

Although the case was technically dismissed and the judges didn't formally declare incompatibility, Thursday's judgment could put political pressure on Northern Ireland's government to deal with the issue.

Cora Shelock, of the Prolife Campaign in the Republic, also welcomed the decision for the reason that there will not be a legal requirement to change the laws in Northern Ireland.

Ms Smyth said she believed the case was lost on a technicality.

The High Court in Belfast ruled in 2015 that this was incompatible with human rights law.

"The women of Northern Ireland deserve better, they deserve control over their bodies, they deserve not to be forced to court and talk about these issues in order to get government to listen". The judges said if it was an individual who had brought this case who had been a victim of this law they would have been likely to side with them.

"If a woman takes an abortion pill and has prolonged heavy bleeding, bad pain, faints, or experiences other complications, we strongly encourage her to attend an Emergency Department or GP straight away". If one were to perform or receive an illegal abortion, they could face life in prison. That historic change has inspired many people in Northern-Ireland to do the same.

"However, the Court has indicated how it would have decided the case if the Commission had standing".

Campaigners celebrate result of the Republic of Ireland referendum which showed a landslide decision in favour of repealing the constitutional ban on abortions. Following her death, people took to streets to call for immediate reforms in the country's abortion laws.

However, many pro-life groups in the area have been fighting against the liberalization of abortion laws, emphasizing the importance of fighting for the right to life. The vote is a "rejection of an Ireland that treated women as second-class citizens", she said, adding: "This is about women's equality and this day brings massive change, monumental change for women in Ireland, and there is no going back".
