The Scottish Parliament and Westminster have been at loggerheads for months over how to manage European Union powers that will return to Britain after Brexit, including over state aid for industry, genetically modified crops policy, fishing quotas and farm subsidies, after ministers in London made a series of concessions brokered by the Scottish Conservatives.

The SNP said it would be "outrageous" for the British government to impose the bill on Scotland.

While the Scottish Parliament's refusal to back the bill will not legally prevent ministers from pressing ahead, it will increase the tensions of the impact of Brexit on devolved settlements across the UK.

SNP member of the Scottish parliament (MSP) Christina McKelvie said on Tuesday that clause 11 would allow Ms May's government to start dismantling the devolution framework on which the Scottish parliament is based.

Russell added that agreement could still be reached, however, if the United Kingdom removed the clause from the bill which automatically transfers those new powers to Westminster. The prime minister briefed Conservative backbenchers on Monday about the two options her ministers are considering: a customs partnership which see Britain collecting tariffs on behalf of the EU; and a combination of technological and administrative measures created to diminish friction on a UK-EU customs border.

"This is not some abstract issue - this covers key policy areas such as farming, food and drink, fisheries and protecting the environment", Russell added.

Sturgeon, the first minister and SNP leader, has decided that consultation is not enough, and insists that her government or Holyrood should be given the legal power to block any changes they disagree with. But it would set up a constitutional crisis of a scale not seen in the 20 years since the Scottish Parliament came to be in its current form. On that occasion the UK Government responded by removing those parts of the Bill.

"Those changes mean that, when we leave the European Union, power will be held closer to people and communities across the UK. They have received support from senior Labour and the Liberal Democrat figures in Holyrood and Westminster".

Scottish Greens co-convener Patrick Harvie said MSPs needed to stand against Theresa May and Ruth Davidson's "devolution demolition squad".

Labour's Neil Findlay said there was still time to fix the bill.
