De Lille argues that the cessation clause was invoked as an excuse by a party ready to try any means to get rid of her.

Cape Town - Former Cape Town mayor Patricia de Lille's legal team on Friday argued the Democratic Alliance (DA) and its federal bodies did not strictly comply with proper procedures and the rules of natural justice when it came to the decision to axe the veteran politician.

According to TimesLive, De Lille's application on Friday is to interdict the party from declaring a mayoral vacancy until she can contest the issue of her dismissal in court.

De Lille was sacked from the DA after telling talk show host Eusebius McKaiser that she would resign from the party once her name is cleared.

It concedes that there is hostility between De Lille and her political foes in the city council, but adds that this has been the case for a long time.

The ANC says De Lille's removal has revealed the DA's true colours.

"She doesn't seek to maintain the status quo, she seeks to reverse or rewind the status quo", said Rosenberg.

She wants to compel the party to release the evidence it relied on to charge her‚ including a 30-page letter written by Cape Town councillor J P Smith complaining about her alleged misconduct‚ among other things.

If you look at de Lille's statement in context, you might say, oh okay she actually made it conditional so it doesn't apply to her.

Mpofu also cited the flow of the interview, claiming it was "patently clear" that the context of the conversation with Radio 702 was in her capacity as mayor. She was removed from office on Tuesday after the DA federal executive confirmed the cessation of her membership of the party, effectively removing her from her post.

"We are not dealing with the subjective state of mind of the declarant [De Lille] in question".
