Supreme Court refuses to hear urgent plea against 'Nanak Shah Fakir'

A bench headed by Chief Justice Dipak Misra refused for the second time to consider the SGPC submission that its plea be either heard on Thursday or Friday as it would be rendered infructuous as the movie is slated for release on Friday. However, the court chose to take up the matter, not before April 16.

Members of the community have demanded a ban on the release of the film, which is supposed to hit the screens on April 13. The bench had then listed the matter for hearing on Monday.

However, the bench, also comprising Justices A M Khanwilkar and D Y Chandrachud, refused urgent hearing, saying once a film has been granted certification by the Central Board of Film Certification (CBFC), its release can only be stalled through lawful means.

The movie is scheduled to be released on Friday after the Supreme Court gave its clearance. In court, Sikka maintained that the changes were made, and were accepted by the CBFC as well. "Outsiders can not be allowed to curtail the freedom of speech and expression".

Nanak Shah Fakir is a movie which came to news by the controversy of humans portraying Guru Nanak Dev Ji.

The bench had said the petition presented yet another picture of "many a private body endeavouring to curtail the freedom of expression of the idea of an author scripted in celluloid language because they have a perception that there will be some kind of law and order situation if the film in question, namely, Nanak Shah Fakir is released in movie halls". The court directed the Centre to ensure maintenance of law and order and made it clear that it was not granting any ex-parte relief to DSGMC without hearing the film producer.

He said the clergy had also directed Shiromani Gurdwara Parbandhak Committee (SGPC) to immediately send its delegation to meet Union home minister Rajnath Singh to apprise him of the Sikh religious sentiments due to the "highly objectionable movie" and ask him to impose an immediate ban on its release. The film based on first Sikh Guru, Guru Nanak, is set for release on 13 April. He, however, has stated in the plea that he would not release the film in Punjab.
