The new filing was part of a court case claiming that either Cohen's legal team or a special master should play the primary role in initially deciding which of the materials seized in the April 9 raid are protected by attorney-client privilege, instead of leaving it to prosecutors.

Who's on the taint team?

At issue is who controls the process of winnowing out legal communications from business matters, determining what is relevant to the investigation, and identifying what is privileged and what is unprivileged because it involves crime or fraud - and how long the process takes. But the president's lawyers are suggesting the taint team proposed by prosecutors might be compromised.

In Stewart's case, which also took place in the Southern District of NY, her lawyers successfully objected to federal prosecutors using a "taint team" to review her attorney's files, and the court allowed a neutral special master to review the documents, also allowing Stewart's team to review the documents as well.

Cohen's lawyers were required by a federal judge in NY to disclose the names of his clients Monday as part of an argument over attorney-client privilege and how it applies to records seized from Cohen last week by the FBI.
