Judge allows woman's taped testimony at her own murder trial

The prosecution said on July 15 that year a gang led by Nadesan allegedly assaulted the duo to death

Judy Malinowski died in August 2017 in hospital where she spent two years clinging to life after being set on fire by her ex-boyfriend.

After Malinowski's death, a grand jury indicted Slager on aggravated murder and murder charges.

Malinowski lost both her ears and two fingers in the attack and was abandoned open wounds on her buttocks and back.

Michael Slager was arrested after the attack in 2015 and was later jailed for 11 years for felonious assault.

Judge Guy Reece on Friday ruled the jury will hear the almost two-hour taped deposition, recorded by Judy Malinowski from her hospital bed before her passing in August 2017, NBC 4 reported.

Slager'out of being used by mentioning a legal technicality, s solicitors strove to block the tape.

The Ohio judge said officials had not known a case in which a victim would testify at their own murder trial.

Judy Malinowski spoke to media before her death.

She could barely speak but was mustered the strength to give a few scathing words, saying: 'I never knew that a human being could be so evil. "He just stood there and did nothing whatsoever". "I think it's the first step toward what her legacy should and will be".

Slager has previously admitted to pouring gasoline on his estranged girlfriend during a tense 2015 argument - though he has long maintained that he accidentally started the fire while lighting a cigarette for Malinowski, according to the Columbus Dispatch. He had run up from behind to cover her in gasoline.

Malinowski was a mother-of-two.

The state has appealed this decision, and Loveless this morning agreed to delay the trial while the appeal is heard by the state Supreme Court. He goes on trial because of her murder in July.

Her ex-boyfriend, Michael Slager, was sentenced to 11 years in prison after pleading no contest in 2016 to charges including felonious assault and aggravated arson.

Since Garcia's case is associated with Groves', the appeal process also will apply to the first-degree felony murder charge he faces.
