Siale Angilau a 25-year-old member of the Tongan Crip gang was shot dead while charging a witness during his trial

Tenifa had been on the witness stand for 22 ½ minutes when the video shows Angilau standing up from his seat beside his defense attorney, picking up a pen from the defense table and charging.

That's when the unidentified USA marshal shot Angilau four times.

A video recording of the 2014 Utah police shooting of an alleged gang leader Siale Angilau (25) was publicly released today following a decision by a United States District Judge John E. Dowdell on 9 March. It claimed that Angilau was killed by excessive force.

"Angilau was in custody, but he essentially had escaped custodial control for those seconds during which he was executing his plan to assault the witness", the judge added.

An FBI investigation also found the shooting was justified by law.

But the judge dismissed that lawsuit, ruling that under the totality of the circumstances, the Marshal's "use of deadly force against Angilau was objectively reasonable and did not violate his fourth amendment rights".

The family had argued that Angilau was armed only with a pen, and the four shots fired constituted an excessive use of force.

Angilau was shot dead by a US Marshal.

The Angilau family attorney, Bob Sykes, said Monday morning he had not yet had an opportunity to discuss an appeal with his clients but hoped to do so "shortly".

Angilau was one of 17 Tongan Crip members named in a 2010 indictment accused of assault, conspiracy, robbery and weapons offenses.

Faces of nearly all the people present inside the courtroom at the time, including the judge is blurred in the video.

Before he died, the incident prompted US District Judge Tena Campbell, who was hearing the case, to declare a mistrial.

In July 2016, the Utah Headliners Chapter of the Society of Professional Journalists and a coalition of Utah media, including the Deseret News, KSL, Salt Lake Tribune, Fox 13 and Associated Press, filed requests under the Freedom of Information Act seeking the video with the assistance of attorneys from Parr Brown Gee & Loveless.
