Trump Team Weighs Trying to Block 60 Minutes Stormy Interview

Stormy Daniels on Monday offered to pay back the $130,000 she was paid to clam up about her alleged affair with President Trump - but only if she's allowed to speak freely and only if the commander-in-chief signs a new agreement on the deal.

Clifford's attorney, Michael Avenatti, sent Cohen a letter offering to wire $130,000 by Friday to an account designated by the President.

Trump's lawyers are reportedly preparing a legal action to block Stormy Daniels" silence-breaking interview with "60 Minutes' from airing next Sunday.

The Times reports that her lawyer, Michael Avenatti, set a deadline of noon on Tuesday for Cohen to answer.

According to the New York Times, Stephanie Clifford, who goes by Stormy Daniels professionally, would return the money so that she could speak openly about the alleged affair, Trump's attempts to keep her quiet and use and publish any "text messages, photos, and/or videos relating to the President that she may have in her possession", without legal effect.

President Trump has flatly denied having an affair with Clifford from 2006 through 2007, so arguably he has nothing to lose.

But Clifford's lawyer Michael Avenatti filed suit last week, claiming the nondisclosure agreement is invalid.

Daniels would also be allowed to "publish any text messages, photos and/or videos relating to the President that she may have in her possession, all without fear of retribution and legal liability for damages", it said. Cohen admitted to making the October 2016 payment to Daniels but said the money came out of his own pocket, and claimed that neither Trump or anyone affiliated with his former campaign or business had any knowledge of the transferred funds.

The offer to return the money was made in a letter from Daniels' lawyer.

"The settlement agreement contained an arbitration clause that permitted EC, LLC to seek an injunction in the event of a breach or threatened breach of the agreement", Rosen said in a statement to Fox News last week. Although a judge might rule that Daniels must stay quiet until the lawsuit reaches a conclusion, an injunction would not undo the interview she gave last week or compel CBS to pretend it didn't happen.
