Swiss Apple store evacuated after iPhone 6s Plus battery starts emitting smoke

Thune's questions seek answers on if Apple throttles iPhones older than the iPhone 6 and 6S as they age, if the company has tracked consumer complaints about the slowed performance and if Apple would offer rebates to those who already purchased new batteries before the company started offering discounted rates. Soon after a class action lawsuit was filed against the company. Planned obsolescence is illegal in France, and if found guilty, Apple faces hefty fines and its employees possible jail terms.

As reported by Patently Apple, this week alone five United States law firms filed separate iPhone slowdown class actions, including one from Hagens Berman, the firm behind the case that ended with Apple paying a $450m fine over eBook price fixing.

Thune, who heads the Commerce, Science and Transportation Committee, wrote to Apple CEO Tim Cook that regardless of intention, the lack of transparency by the company was a reason for his questioning. The software was created to monitor for reduced peak power - a natural side-effect as lithium-ion batteries get older - that could cause problems if system-intensive apps and features demanded more from the iPhone's processor than there was power to deliver.

That disclosure played on a common belief among consumers that Apple purposely slows down older phones to encourage customers to buy newer iPhone models.

"Last year we released a feature for iPhone 6, iPhone 6s and iPhone SE to smooth out the instantaneous peaks only when needed to prevent the device from unexpectedly shutting down during these conditions".

Now, it seems, demand for that has placed serious constraints on battery availability.

But at least now you can get a $29 mea culpa from Apple - even if you have to wait for it.

Cue Geekbench. The organisation benchmarked the performance of iPhone 6 and iPhone 7 devices running on different versions of iOS to see how the kernel density changes as the operating system is updated.
